Extension available for “Notification of Provisional Refusal”
With the revision of Law effective on April 1st 2016, extension is available for responding to the “Notification of Provisional Refusal” (refusal under the Madrid Protocol) before the JPO.
The original deadline is 3 months from “the date of pronouncement”, i.e., it is January 20th, 2020 if “the date of pronouncement” is October 20th, 2019. (“the date of pronouncement” is indicated at the bottom of the first page of the “Notification of Provisional Refusal”)
To request for extension of the deadline, there are 3 cases according to when the request is made.
The key idea is, you can request only for “1-month extension” before the original deadline, and only for “2-month extension” after the original deadline.
Case 1; Request for 1-month extension filed before the original deadline
Case 2;Request for 2-month extension filed after the original deadline
Case 3; Request for 1-month extension filed before the original deadline, and request for 2-month extension filed after the original deadline
